Education of the middle ages Education, as we know it today, did not exist in the Middle Ages. Illiteracy was dominant among the population. Scribes were the exception to the rule. Churches were the main source of knowledge and schooling. Real interest in learning grew along with the development of towns. The towns’ officials needed to be educated. At the same time a need for legal institutions was created and so started the university phenomenon. Modern education was on its way. There were few schools in the Middle ages, so everyone had limited education. Even the Lord of the Manor was often unable to read or write. Some of the first schools were Cathedral schools. As well as Parish, Monastic, and Palace schools. Here people learned a particular role in society. Naturally the primary job was training the clergy in their professional duties as priests of the Christian people. The bishop was the head of the complex and he had a staff of priest to help him with the several of the diocese. These skills that were taught here were reading, singing of hymns, church law, writing of documents and the performing of Church duties and sacraments. An example of educating for a specific role in life were the Knights who had learn how to fight with various weapons so that they could fight for their king.   Ã‚  Ã‚  Ã‚  Ã‚  The common people, however, had no way of being educated other than going a monastic school. However, if they did this, they had to donate their proper ty to the church. The people who went to this school later become monks or nuns. Most monasteries had a rule of silence: monks could not talk which other except for a short period of time. During meals one monk might read passages from the bible while the others mediated. (Bateman, Abesamis-Mendoza, & Ho-Asjoe, 2009) It is not uncommon for â€Å"handaans† to be held once weekly with members of the family reaching out to their relatives. Living conditions for the Filipino families include multiple family members living under one roof. Priority and reverence of the elderly family members living in the home are apparent by watching as to how the younger members of the family dote on and care for their elders. As elderly members of the family progress in age and may be in need of advanced care it is not uncommon for the family members to care for their elder at home versus being confined to a nursing home as this is considered disrespectful and forbidden. The family interviewed claims a Christian based faith and attends regular services of the Catholic doctrine. Even more, in regards to health decisions within Filipino families are completed together with everyone ensuring the wellbeing of the entire family. This being said, some illnesses and mental health issues are seen as an exception to the rule due to the families strong religious beliefs and customary values associated with mental illness and negative spirits that attack one’s body after some way wrong doing the Gods. (Bateman et al., 2009) If a member of the family unit becomes ill the relatives offer emotional and physical support to assist with health restoration. Let’s take  for example, by utilizing traditional Asian treatments such as herbal medicine, acupuncture and acupressure Filipino families engage in restorative treatments. Often time’s acupressure will be utilized to relieve pain, nausea and depression and by utilizing small needles to specific pinpoint locations of the body acupuncture may be used to treat colds, itching and acute conditions. Herba l medicine assists with health restoration, maintenance and the populace that may be vulnerable. . At home the family enjoys their Asian delicacies; with emphasis on healthy diet to enhance body immunity. The health traditions are maintained across generations through apprenticeship, rituals/cultural events, and mentorships (Bateman et al., 2009). The second family was of the African American decent that was interviewed. Cultural systems of African Americans have been hindered after arriving to the U.S. African American cultural values and beliefs are deeply rooted in Africa, mainly Sub-Saharan African as well as Shelean cultures (Quaye, 2005). Unlike Filipino families, African American family units tend to be more loosely connected and focus more on the annual reunions and get-togethers. It is not uncommon for family members to see each other once a year or for special occasions. As family concerns and issues become apparent contact may be made via a telephone call at which time family members may then provide advice or support. The family interviewed considered themselves to be Baptist and go to church on special occasions stating that they often congregate with others of the same faith outside of the church setting. In regards to healthcare the family sees illness and other health issues as â€Å"getting aged† or jus t growing older. The matriarch of the family is willing to share that they have a strong familial incident of hypertension, cardiac disease and other illnesses that are culturally common within their heritage. Even though the family does not freely talk about illness directly to the affected member of the family it is not uncommon that they discuss it among themselves. Though African American uses mainstream treatment means and therapeutic approaches, health restoration and maintenance is purely based on adherence to a healthy diet. (Quaye, 2005) Life sustainment and  prolonged treatment may be sought during times of terminal illness but depending on economical standing may be averted. Medical support systems and preventative care are occasionally sought after within the community setting during health fairs for screenings for illnesses such as prostate and breast cancer during the onset of old age. The health traditions are retained through kingship and extended social networks where close and extended families pass on treatment traditions and beliefs across generations (Quaye, 2005). The last family interviewed was of Hispanic decent and unlike the Filipino and African American families has very little contact with their relatives as most immediate and extended family members live in Mexico. Although the family can contact each other via phone and social media they rarely visit in person due to crossing the border. The family practices Catholicism and attends mass on a regular basis. Further, the interviewed family, like other Mexican families, views the cause of illness or diseases as jealousy against others or due to resulting imbalance between cold and hot. (West, 2005) Herbal remedies and treatments are a common Mexican health tradition to fend off the illness and keep the sick family member warm and the use of oil is utilized to ensure the patient is protected from dehydration. It is not uncommon for the family to use traditional cures for heath restoration such as Curanderos or conditional care for illnesses such as diabetes. Home remedies are often passed down from generation to generation. During chronic conditions, health restoration and maintenance may be done through conventional treatment, but only after the mother convinces the father the importance of doing so (West, 2005). In conclusion, the three immigrant families show distinctive ideas and beliefs of traditional health maintenance and wellness after arriving the U.S but it can be seen that they share a common belief in faith as indicating their value systems towards restoration and feel they are protected by their Christian faith .When planning for wellness and health maintenance as well as restorative care it is important to consider family background, beliefs, values regarding the ailment and develop interventional measures that observes specific traditions as well as cultural and religious values. Uncle Tom’s Impact on 19th Century America

For slaves, the passing of the Fugitive Slave Act of 1850 ensured their doom in the perpetual cruelty of the slave market. This Act protected the rights of slaveholders, requiring – by law – that all slaves who escaped to the North be returned to their original owners. This action by the United States government contributed significantly to the novel Uncle Tom’s Cabin by Harriet Beecher Stowe. The novel was the first of its kind to express and fully embrace the idea that slavery should not be condoned. At the time this text was published, many Northerners took the pacifist approach by simply accepting the idea that â€Å"one person couldn’t change anything†, like St. Clare in the novel. Once this book was introduced to the Northern population, not only did it sell like hot cakes, but also it opened citizens’ eyes to the actual horrors occurring in the South, and under their same Constitution. They saw that merciless slave owners and continuous beatings left slaves with little hope and little faith. The sympathetic portrayal of slaves throughout the South lead many Northerners to side with the extreme abolitionists, which would soon create further tensions among the North and the South and eventually cause the friction prompting Southern states to secede and begin the Civil War. This progression of events inspired Abraham Lincoln’s famous quote to Harriet Beecher Stowe when he met her, â€Å"So you’re the little woman who wrote the book that caused this great war? † Although the original intent of this novel was to educate the unaware masses, Stowe fell into some stereotypes of black men. When â€Å"Black Sam† received the order from Mrs. Shelby to slow down the retrieval of Eliza so that she may escape, it is clear that he does not care whether Eliza gets to freedom, but is purely interested in whether, if he succeeds, he can take over the spot of â€Å"trusted slave† that Tom filled. Stowe basically describes him as the â€Å"comic† black figure. A â€Å"comic† black figure is drawn into the book for the amusement of the white audience, which, in itself is a horrifying thought. This portrayal shows him grinning dumbly and failing to use large words correctly. He also is screeching in broad dialect and â€Å"seems ready to break into an comic dance†. It seems as if, especially with the inclusion of the cartoon, Stowe was playing into overdrawn racial stereotypes of the day, and implying that only some slaves had the capacity to function normally in society while others could not. Although Stowe mocks Haley (the slave catcher and seller) in this chapter, it seems as if the representation of the average slave undermines the positive image she is attempting to draw for slaves such as Uncle Tom, Eliza and George Harris. Some points made in the novel were ironic to me. I thought it was interesting how being a â€Å"white n—-â€Å" was something undesirable in the slave community. When a large slave comes up to Adolph and said â€Å"Law, now, boys! dis yer's one o' yer white n—–s, — kind o' cream color, ye know, scented! † The situation slaves were put them made them resent white people to such a degree that it was terrible to be a â€Å"white n—–â€Å". It is ironic also that they themselves used the term â€Å"white† with the derogatory term â€Å"nigger† to insult someone n their own community. One might have thought – given the ability whites had to roam free and easily – that being white was a good thing. Of course, being called â€Å"white† had more to do with the fact that these slaves associated â€Å"white n—-â€Å" as a portrayal of their oppressor, and by calling one of their own a â€Å"white n – – – – â€Å" they were lashing out at their oppressors and anyone who tried to emulate them. The idea of a â€Å"white n—-â€Å" also brings to mind how close these slaves are to their owners making the reader question â€Å"How different are these people that they can be considered property while I can be considered free? † No Doubt Uncle Tom’s Cabin by Harriet Beecher Stowe had the power to turn average, every day, on the fence Americans into full-fledged abolitionists. Stowe was able to accomplish this by relating the oppressed slaves to people in every day life, whether it was through Eliza’s attachment to her son, or Tom’s embrace religion in the toughest of times. Stowe also shows that a girl who grew up in the heart of the South could show compassion for people she was raised to believe were so beneath her and so horrid. Her strength and faith – and her recognition that the key was to see slaves as people – also influenced those around her. Stowe’s fictional tale of Uncle Tom not only touched the heart of Northerners, it also touched Southerners, and – most importantly – it contributed to the commencement of a great civil war; one that would end with the emancipation of slaves everywhere.

If you get confused by the difference between compliment and complement, or if you’re unsure which to use when, read on. Compliment Merriam-Webster defines a compliment as â€Å"an expression of esteem, respect, affection, or admiration; especially : an admiring remark†. It comes from Middle French, via the Italian complimento, and the Spanish cumplimiento, which originates from the Latin verb cumplir: to be courteous. For example: I was trying to pay that girl a compliment, but she ignored me. Sometimes he blushes when you offer him a compliment. In the plural, compliments can also mean best wishes. It is often used as â€Å"with compliments† such as on a compliments slip (a small piece of letter-headed paper, often used by companies for a quick note to a customer or client when a full sheet would be too large.) You also see the phrase â€Å"with compliments of the season† in greetings cards. The verb â€Å"to compliment† is very similar, meaning â€Å"to pay a compliment to†. Note that it is a transitive verb so must have an object. For example: Are you trying to compliment me, or trying to insult me? When he complimented the girl on her dress, his friends laughed at him. Services in all fields need to be increased and improved that is in organizational centers, health centers and educational centers because among the immigrants there are disabled people or people with special needs and they all expect assistance from the government. The issue of ethnicity is still there among various groups of people and this has led to gender difference and reduced sexual orientation. The uniformity that is beyond our internal extents there is outward effects of life practices, plus the choices we decide in our lives also affect our chances, circumstances, and elevations and since these controls, outward extents of religion, maternal prominence, and presence may influence others to create conventions about the immigrants (Naylor 1999 ).   Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚  Ã‚   Therefore, diversity need to be fostered in all terms of climate of acceptance and cultural pluralism in the United States in the following ways. This is a recognizable point, but it is most forgotten idea when the subject of multiethnic education is raised. Second, they need a broad considerate of our form of government and its organizations because we live in a country in which we enjoy countless freedom, but we also live in a country in which people are extremely unconcerned. Third, we must teach our children the history of this United States and there are many sources where we can get that history. Finally, all American kids need a well understanding of the world in which we live, and this includes something of the history of other nations. They need a foundation in geography, which, if shown we ll, will also teach them why nations advanced as they did. These organizations were unable to recognize the change in the environment and were rejected by the environment. The organizations that have been proactive and managed change have been success stories .i.e. Microsoft, 3com and us robotics, Cadbury and Kraft etc. these organizations have changed there strategies at the right time, they were the leaders of market change. Introduction to General Motors General Motors Corporation (GM) is the worlds largest full-line vehicle manufacturer and marketer. Its arsenal of brands includes Chevrolet, Pontiac, GMC, Buick, Cadillac, Saturn, Hummer, and Saab. Opel, Vauxhall, and Holden comprise GMs international nameplates. Shared values is what type of culture prevails in the organization Style is the leadership style of the management. How are decisions made? Staff is the human resource of the organization. Need for strategic change in General motors General motor is a fallen giant. Glory of the past from being a great market leader to bankrupt company General motors has come a long way. GM failed to realize the change in the industry and technology and constantly lost market share to the Japanese companies. The strategies of the Japanese and GM can be compared with each other and get to what GM needs to do in order to get its former glory. Strategic intervention techniques The purpose of intervention techniques is to improve the efficiency and the effectiveness of the organization. Strategic intervention techniques focus on improving the processes through which ideas are generated and then gain feedback on the ideas. Manpower of GM has not been able to generate new ideas which show dulled motivation, and poor creativity skills by the management and other employees. Also GM is stuck in contacts with employees with huge pensions. Minutes time frame for adaptation has always been short for GM and it has always lagged behind the need of time. Material has very special item oil which has sky rocketed. So the price of car manufacturing is rising as well as the price of maintaining a car. Machinery has been the major issue for GM as its competitors have acquired new machinery and processes which are better than that of GM. Due to these factors GM has not been able to change. These are the forces that create resistance for change. Change and stakeholders Stakeholders are an integral part of the organizational paradigm. To bring change in the organization, stakeholders should own the change. The process of change should start from within the stakeholders. To change the culture stakeholders should realize that there is a need for change. Then they should be directed into the right direction. In Kotters 8 steps model for change the role of stakeholders can be incorporated. The model pushes the organization to make its own decision and define its process of change. Kotters model for change for GM Kotter gives a model of change in the organization in which the stakeholders are empowered to make change for themselves. I shall use this model to explain how GM can bring about change in the organization with the help of its stakeholders. Step 1: Create urgency For change to occur it is necessary the whole organization realizes the need for change and puts its effort in making the change. For this purpose managers can paint a grim picture of the future if continued on the same path. Explain to the shareholders the increase in ability of the organization to exploit its resources. There should be feed back from the stakeholders and there ideas should be incorporated in the change process. In case of GM it is not very difficult to paint a grim picture because the next step to bankruptcy is liquidation. The decline in the performance of the company has been a question mark for a long time now. So in GM people are ready for change and stakeholders support the management. Now there is need for discussions so that the ideas and the wills of the stakeholders can be incorporated in the change process. Step 2: Coalitions This is the point where the leadership emerges; people among the stakeholder should take charge of the groups. It is necessary that to identify the key leadership and make them commit to the change in the organization. This is necessary that people who are selected for the leadership believe in the change. In case of General Motors they have to find leaders in order to bring change. Recognition of the people who will help GM to evolve and to accept the changed processes is necessary, if it wishes to make any type of change in its strategy. Step 3: Vision for change When the process of change starts there are many idea of floating. All these ideals need to be linked together if in order to form a vision. This vision needs to be simple and understandable. The vision gives people a sense of direction; they understand the purpose of the change. For change to be successful you need to know the main idea behind the change. For this purpose prepare a summary of the future endeavors of the company. Knowing about the future helps people to support the organization. In case of General Motors the mission statement is quite clear G.M. is a multinational corporation engaged in socially responsible operations, worldwide. It is dedicated to provide products and services of such quality that our customers will receive superior value while our employees and business partners will share in our success and our stock-holders will receive a sustained superior return on their investment. But unfortunately General Motors has not been able to deliver. The vision of the General Motors needs to be communicated effectively through the organization. Every stakeholder needs to believe in the mission statement of General Motors. Step 4: Communication of vision Every person in the organization needs to know the objective of the change. The previous paradigm of the company will produce resistance against the new method. The New Mission statement needs to overcome the resistance and unite the organization on a single path to success. For this the management needs to address all the doubts and problems of the people. Divide the vision into smaller objectives and tie the performance of individual with the achievement of these objectives. In General Motors the management should take responsibility of communicating process of change through the organization. A process of change developed from the input of stakeholders is easier to communicate back. Step 5: Remove obstacles In the process of change, there will always be resistance. The objective of the management is to minimize this resistance and bring the stakeholders to a common platform on which everybody can express their opinion. As the process of change moves forward, there should be constant checks for any barriers to change. In General Motors the inner management has failed to provide change in the organization. The change in GM can be induced from the outside; perhaps a change agent will help GM over come change barriers. Another good way to bring about change is to award the people who embrace the change. Step 6: Create short term objectives For the process of change to work people need to know that it is working. For this management can divide the main objective in to simpler objectives. The management should thoroughly analyze the short term objectives such that they are achievable and motivation. For the achievement of every objective the employees should be rewarded. In General Motors that management need to step up and divide their long-term objectives into the short term goals. The management should make the stakeholders believe that they are capable of changing the business for the better. The most important stakeholder of GM is the government. The government needs to know that that GM can stand on its feet, for it to bail out the company. Step 7: Build on the change The process of change is not complete he unless and until the change culture has inculcated into the organization. Changes in many organizations fail because they do not fully implement the changed processes. The changed processes should become part and parcel of life in the organization. The people of the organization need to build on the changed processes and achieve even more success. The management of General Motors should not stop at making the government believed that they deserve a bailout, but should make efforts to build on the changed processes. Step 8: Change in corporate culture The most difficult thing to do in bringing about change into the organization is to change the culture of the organization. In history many of the mergers in companies have failed because they unable to merge the culture of the companies. Changing the culture of the company is a very long and hard process. General motors will need to change the culture and introduce a fresh method to succeed in an unattractive industry. At this point the employees of General Motor will not be motivated; the management needs to bring faith back into the employees. Monitoring progress and conclusion The final step in the management of change would be to monitor the performance of the company. For this purpose appraisal of each of the activities of the company will be performed. The justification of activity will provide grounds by which the productivity of the activity will be measured. The idea of kaizen should become a part of the activities of the business. The process of change is very lengthy; it takes years for change process to become part of the culture. The management of the organization needs to be very patient and need to prioritize their objectives. In General Motors it is necessary that people accept the change and once the changed processes have settled in there should be continuous evaluation and revaluation. The U.S market has become very saturated thus not allowing the companies to grow as fast as they would like. For the companies to survive they need to use there resources with utmost efficiency.

Humorous Best Man Speech Good afternoon ladies and gentlemen. Firstly on behalf of the bridesmaids, I would like to thank the groom for his kind words, and may I also say that they have done a fantastic job today and all of them look absolutely beautiful. I'd also like to say that the bride looks absolutely stunning today as I’m sure you will all agree. Unfortunately for the wedding photographs, the groom just looks stunned. When I was asked to be best man I consulted the Internet for help. I must confess I was perplexed by some of the things I was expected to do: Help the groom dress. Thanks, but no thanks. If he hasn't learned by nor then he never will. That his shoes are tied. That his face and hair are â€Å"in order† (God didn't put them in order first time round, I'm not convinced that I stood a chance) . That he has nothing between his teeth (or is that his ears?) That his trouser flies are done up. I came to the conclusion that best man is just a fancy title for nanny. I also found out some other interesting things on the Internet, but now is definitely not the time to tell you what they were. However, I have taken the job of being best man seriously and have made sure: That he got to the service on time. That he was well dressed and looking smart, which I’m sure you will agree he is. And that he got a good nights sleep last night, and I’m pleased to report he slept like a baby. He woke up every half hour like clockwork, crying for his mom. So what can I say about the groom. Well, he’s witty, intelligent, charming, successful, han†¦ han... Sorry. I'm having trouble reading your writing. I've been racking my brain for the last couple of weeks trying to think of suitable stories to be said about... ...Now. if you could join me in a toast to some very important people, without whom today just wouldn't be the same. I'm sure all of us at some point will shuffle past them and exchange a few kind words. Ladies and gentlemen, I'd like you to raise your glasses and say a toast. To the bar staff. And of course we should not forget the bride and groom. I would like to say to you both: "May your love be modern enough to survive the times, and old-fashioned enough to last forever." Is Macbeth a hero or a murderous tyrant? Discuss Essay

Macbeth, the Thane of Cawdor was a murderous tyrant without question. Macbeth was originally considered to be a ‘hero’ at an early stage in the play however; the people of his Kingdom soon saw another side of him which turned him into a ‘butcher’. It is clear that through all of Macbeth’s schemes of becoming king, such as killing King Duncan and then his friend Banquo, he was a bloodthirsty and ruthless man. This malicious and tyrannical behaviour was not evident in Macbeth’s character early in the scenes, but became obvious as the play progressed and more and more people died because of him in an attempt to keep a secret. Killing Duncan for his position of King was the secret that Macbeth tried desperately to hide. He and Lady Macbeth thought that the crime they had committed would easily be erased with the simple washing of hands to remove the blood. The criminal pair went to the extent of framing other people for their crime so that they would not be even considered as the culprits. Dressing in their nightgowns before they went back to bed and ridding their bloody clothes was also an attempt to draw no suspicious attention to themselves. However, the traumatic incident that Macbeth experienced when killing an innocent, good man was something that would haunt him for many nights to come. Macbeth became paranoid after the awful deed and confided in Lady Macbeth saying that Methought I heard a voice cry†¦ â€Å"Sleep no more!’ to all the house†¦ Macbeth shall sleep no more’. As well as being haunted by his dreams at night, Macbeth had suspicions of Banquo’s knowledge of the murder and so, had to put an end to it. Macbeth, through his greed, murdered Duncan for power and the throne, and then, through the aid of henchmen, he killed Banquo also. To Macbeth, murder appeared to be the only sure way of keeping his secret that he was convinced Banquo would reveal. Our fears in Banquo stick deep, and in his royalty of nature reigns that which would be fear’d: ’tis much he dares. Macbeth was scared that his and lady Macbeth’s crime may come undone and so, once again, took to murdering the innocent. As well as Banquo, Macbeth instructed the henchmen to make Banquo’s son Fleance, embrace the fate of that dark hour. That is, kill Fleance also to stop him from revealing his fathers murderers, and therefore link it back to the King. This murderous intent from Macbeth was due to not only fear but also jealousy. Macbeth would not have royal descendants unlike Banquo according to the witches. So, by murdering Banquo, he thought he would succeed in concealing King Duncan’s death once and for all. By murdering Fleance, he would also prevent the line of Banquo continuing and becoming kings themselves. These actions of Macbeth were the beginning of the stage where he became desensitised to cold-blooded murder and therefore, as it did not affect him anymore, he became a ruthless and murderous tyrant showing no mercy. Macbeth had already been responsible for two deaths (as Fleance escaped the attack) and was in no hurry to cease until his position of king was not threatened. His murderous ways had paid off to a degree and now, because of his confrontation with the three apparitions in the woods, he felt invincible as they said. None of woman born shall harm Macbeth†¦never vanquished be until Great Birnam Wood to Dunsinane Hill shall come against him. It was after this discovery of his newly charmed life, that Macbeth truly turned into the ‘butcher’ that some had expected, and others had not. Originally known as brave Macbeth, over the series of murders and problems he had faced with seeing ghosts of Banquo, his fair, noble and valiant exuberance was lost and in its place, a malicious, merciless and murderous tyrant was born. Tyrant was the name given to Macbeth and he lived up to his title (through the use of henchmen again) when he massacred Macduff’s castle inhabitants. Macbeth was told to â€Å"beware Macduff† and when Macduff defiantly refused doing something and fled to England, Macbeth was immediately angered, determined to get his own back. The castle of Macduff I will surprise†¦give to the edge of the sword, his wife, his babes, and all unfortunate souls that trace him in his line. Murderers seized Macduff’s castle and everyone living there was brutally slain under orders of the King. Even though all slaughtered were unknowing and innocent to matters regarding Macbeth, because of this desire to hurt Macduff, the emotional trauma would be the real weapon against him. Because of Macbeth’s murderous and tyrannical ways, being affected by death became an unheard of reaction and this was particularly evident when, just prior to battle, he was notified of his wife, Lady Macbeth, committing suicide. Macbeth barely cared about this and was focused more on the war rather than his wife’s tragic death. An explanation of this indifferent response is based upon himself becoming a murderous tyrant, desensitised to the unnecessary execution of many innocent lives. Therefore, his wife’s death held no importance, in fact more of a nuisance as â€Å"She should have died hereafter; there would have been a time for such a word.† Macbeth had no understanding anymore about his actions. Macbeth was a murderous tyrant. The barbaric and ruthless actions that he went through with were unnecessary and were carried out for the tyrant’s personal power gain and stability in the throne. A tyrant cannot be a hero just as a hero cannot be a tyrant. The change from hero to tyrant in Macbeth’s self is clearly evident and cannot be mistaken for anything but murderous. Not grieving his wife’s death, organising for his friends murder and murdering a good and noble king is evidence to prove that Macbeth was desensitised to killing. Macbeth killed everyone that attempted to stand in his fate’s way and regardless of innocence; they were brutally murdered. These actions clearly prove that Macbeth was an abominably murderous tyrant.

Judicial Method: Activism vs Formalism

‘Judicial Method: activism versus formalism’ A new era has emerged from the societal and legal changes that have occurred in Australia. The age of Judicial activism has taken over the more traditional method of judicial formalism. Supporters of the latter’s concerns that it promotes power without responsibility, and blurs the separation of powers, however the supporters of the former agree that inevitable changes in society force the judiciary to acknowledge that judicial formalism is a method that is not completely obsolete, but takes is less of a primary concern as it were, compared to other factors that effect a case. Those who are in favour of judicial activism argue that social change has increased the need for legal change and judges need to be able to make decisions considering external factors and using processes other than the law that make judicial method more subjective, adhering to legislation and legal policy but giving more significant acknowledgement to situational factors. The Honourable Michael Kirby’s pro-activism article centers around the view that judicial method must divert from the traditional method of legalism that Justice Kirby defines as â€Å"strict logic and high technique†. It starts by outlining the need for the judiciary to make this transition into judicial activism due to societal changes, where strict legalism is put under pressure. Justice Kirby then goes on to explain that the method of judicial activism should not be abused by the judges, where it should â€Å"be anchored in legal authority† and be â€Å"neither wholly mechanical or excessively creative†. He describes that â€Å"restraint† be used when using judicial activism to ensure that a total ignorance of the written law does not occur . A similar article about pro-activism by Michael Coper agrees that the â€Å"phenomenon of social change†¦. has accelerated the rate of legal change† and put a â€Å"pressure on concepts like ‘strict logic and high technique ’, thus supporting the viewpoint that judicial activism is a reaction to social change. Another article by Frank Carrigan praises Justice Kirby’s use of judicial activism directly, outlining this by comparing Justice Kirby’s methods with Gava, a strong believer in the Dixonian theory of legalism. It explains that even Chief Justice Dixon J, considered to be a leader in the legal formalism movement, used contradictory methods of judgment, promoting legalism but applying judicial activism . This is evidence that change to judicial activism is inevitable as societal changes occur. Pertaining to the other articles, however, there are some shortfalls in Justice Kirby’s article that must be addressed. Firstly, the article does outline that certain â€Å"restraint† must be used when applying judicial activism in the process for a judgment. However, exactly how this restraint will be measured, or the factors to be considered in which a judge’s judicial method is considered to cross these boundaries are not mentioned in his article. He also fails to describe the consequences of the divergence of judicial formalism, that a failure of the independent judges to keep external factors other than the legal text as impartial dynamics rather than personal ones would result in a cataclysmic failure to achieve justice. A loss in consistency would result in a loss in public confidence in the judicial system. Also, Justice Kirby’s proposal of a more transparent judgment, where the judicial method and processes used to achieve a judgment is open to the general public for critique, may be a technique in which to make sure that a judge does not overstep the restraints, but by openly presenting the judicial method and decision process of a controversial judgment for critique to a society that is already critical of the judicial system may backfire and result in a further loss of public confidence instead of building credibility. Contrasting against Justice Kirby’s heavily biased pro-activism article, is Justice Heydon’s article that describes the absolute need for adherence and paramount importance to the impartial application of the legal text. Justice Heydon’s article clearly outlines what Justice Kirby’s article does not, the downfalls of having a judiciary use judicial activism. Justice Heydon points out that by allowing judges to use judicial activism, it â€Å"tends to the destruction of the rule of law† by impairing two qualities that are expected of a judge, a â€Å"firm grip on the applicable law [and]†¦total probity. The article continues to state that there is a blurring of the separation of powers, and this becomes a problem as the facility for a legislature to make laws compared to that of a judge results in concerns about the clarity, inconsistency, decisiveness and retrospectivity of the laws that are changed or made by the judiciary. Justice Heydon pro poses that it is not primarily the function of the judiciary to create and change laws, that it should be a limited amount, limited to the legislature, and that the failure to adhere to judicial formalism or legalism would result in failures in various areas of the application of law . John Gava’s article adds to the need for strict legalism, by indicating that human error in judges can create issues in consistency, and that with a â€Å"state of mind† the is of legalism, a more â€Å"institutional mindset† can be achieved that relies more on a collective wisdom which create decision that conform, rather than those that are more individualized when judicial activism is applied . Owen Dixon’s article further outlines a deeper issue at hand with the abandonment of judicial formalism, the loss of the ability to develop legal principle. It states that there was a â€Å"attempt to develop the law as a science† which would not be possible by neglecting the very â€Å"strict logic and high technique† that is constantly used to describe legalism . As with any legalistic paradigm or state of mind, it is inherent that there will be a pro to a con, an advantage to a disadvantage. According to these articles it is clear that the more common emergence of activism is due mainly to societal change, and the resurrection of formalism has occurred due to concern for the drawbacks that takes place with activism, and rightly so. The former three pro-activism articles and the latter three pro-legalism/formalism articles compliment each other in revealing the advantages and flaws of both judicial methods. After the analyses of these articles, it is apparent that an appropriate balance between the two judicial methods be maintained, always changing, according to the change in Australia’s society.
